About the Act:

The Industrial Disputes Act, 1947, is a key legislation in India aimed at resolving disputes between employers and employees. It provides a framework for the investigation and settlement of industrial disputes, ensuring fair practices in labour relations. The Act establishes mechanisms for conciliation, arbitration, and adjudication to address grievances. It also outlines the rights and responsibilities of both employers and workers, promoting industrial harmony and stability.

This edition of publication titled “Statistics on Industrial Disputes, Closures, Retrenchments and Lay-offs” compiled on the basis of the information furnished / supplied voluntarily on monthly basis by the Labour Commissioners of the States and the Regional Labour Commissioners (Central) presents statistics on Industrial Disputes resulting in temporary work-stoppages, permanent closures, retrenchments and lay-offs during the year 2022.

1(a). Work-stoppages due to Industrial Disputes

  • Out of total industrial disputes 85.37 percent were strikes and 14.63 percent were lockouts which shows a decrease of 25.53 percent in strike and 33.33 percent in lockout from the previous year 2021.
  • 41 work-stoppages due to industrial disputes (Strikes and Lockouts) occurred in which 298,019 workers were involved and 1,020,722 mandays were lost.
  • There was a decrease of 57.41 percent in the mandays lost as compared to 2021.
  • Of the total disputes, 82.93 percent cases involving 3.75 percent workers resulting in a loss of 53.83 percent mandays occurred in State Sphere and remaining were in Central Sphere.
  • Of the total disputes (strikes and lockouts), 17.07 percent were in the Public Sector which resulted in a time loss of 45.24 percent mandays whereas the number of disputes in Private Sector were 82.93 percent resulting in a time loss of 54.76 percent mandays.

1(b).Work-stoppages due to reasons other than Industrial Disputes

  • The number of work-stoppages due to reasons other than industrial disputes during the year 2022 was 14 in which 2,972 workers were involved and 841,444 mandays were lost.
  •  All of these work-stoppages were lockouts.

2. Closures

  • The highest number of units i.e. 92.5 percent were closed in “Manufacturing Division” (Industry codes 10 to 33).
  • All cases of closureswere reported in the Private Sector.

3. Retrenchments

  • There was a decrease of 53.84 per cent in the number of cases of retrenchment as compared to the year 2021.
  • Out of all cases, 50 per cent each were reported in the State Sphere and Central Sphere.
  • 33.33 percent cases of retrenchment were reported in Private Sector whereas the remaining were reported in Public Sector.
  • 7.71 percent workers were retrenched in Private Sector whereas the remaining workers were retrenched in the Public Sector.

4. Lay-off

  • There was a decrease of 30 per cent of cases of lay-off vis-à-vis 2021.
  • 2837 workers were laid-off which resulted in a time-loss of 564,408 mandays.
  • The number of workers laid-off has decreased by 45.88 percent whereas mandays lost has decreased by 54.98 percent as compared to the year 2021.
  • All cases of lay-offs were reported in the State Sphere.
